Partiendo de distintas racionalidades parciales que, en diferentes pasajes de la historia, han aportado a la idea de persona y dignidad humana, en este artículo se profundiza en lo que significa ser persona, en el sentido de la dignidad que le es propia. Se reflexiona así sobre el puesto que le corresponde en una sociedad justa, a la altura de nuestro tiempo, con las consecuencias que se derivan de ello, particularmente para la moral, la política y el derecho. Un cierto (...) tipo de sociedad donde cada persona pueda encontrar las condiciones adecuadas para el desarrollo de todas las dimensiones de su humanidad y vivir de manera armoniosa en comunidad y con el resto de la naturaleza. Estamos ante una reflexión que busca contribuir a que el ser humano pueda desarrollarse plenamente, con su esfuerzo, pero con el apoyo de los demás. Un modo de convivencia social donde la democracia y el Estado de Derecho se presentan, junto con los derechos fundamentales, como las formas de organización jurídico-políticas más acordes con la dignidad humana, con los objetivos de racionalización y humanización que se persiguen para construir y fortalecer una sociedad justa. Numerous studies have linked the consumption of violent audiovisual content to the increase of aggressive cognitions and behaviors. This research aims to clarify whether the possible harmful consequences of violent videogames might vary depending on an individual variable such as trait aggressiveness. A correlational study was carried out among 6,130 teenagers from two European countries, in which it became evident, by means of multiple regression analyses, that there was a positive correlation between the use of violent videogames and aggressive behavioral (...) intentions. More relevantly, these correlations were greater amongst those subjects with higher scores on the Aggression Scale. Finally, when analyzing the subjective experiences of users of violent videogames, the more aggressive individuals manifested a greater desire to imitate the characters of the interactive content, admitting that they ended up more agitated even when their initial objective was to relieve tension or relax. Practical and theoretical implications of those results are discussed. (shrink)

Este artículo responde a estas preguntas mediante la distinción en (...) la obra spinoziana de dos conceptos de libertad, la verdadera libertad y el libre albedrío, así como con la distinción entre la responsabilidad civil fundada en el concepto de potestas humana -y no en la verdadera libertad, aunque la posibilita-.: Spinoza sustains that the agents' decisions are necessary because they are causally determined. But then, are humans really moral agents? Is it possible that they are only passengers in a train of causes, whose course they cannot control and exempts them from the consequences of their acts, of reward or punishment? Is accepting whatever happens and quitting the aspiration of changing things the hallmark of the free man? This paper answers these questions by distinguishing two concepts of freedom, real freedom and free will, as well as two concepts of responsibility. IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. Se examina la noción de espectro, propuesta en Espectros de Marx, para evidenciar la problematización que Jacques Derrida hace a la oposición, que se supone tajante, entre las nociones de vida y muerte. Se evidencia que Derrida no traza tal problematización exclusivamente a partir de Espectros de Marx, sino también desde diversos textos que dan cuenta de un constante asedio que ronda su pensamiento: la sobrevida. A su vez, se analiza la discusión que Derrida sostuvo con el espectro de Marx (...) para evidenciar: (1) de qué modo la herencia fiel-infiel de Marx contribuye al pensamiento de la sobrevida; (2) cómo en tal pensamiento de la sobrevida se inscribe necesariamente el problema de la justicia y la alteridad. Resumen: Esta exposición intenta comprender las formas culturales de comunicación y fijación mnémica en una narración específica que Davi Kopenawa, chamán Yanomami, expone al antropólogo Bruce Albert, en virtud de los modos de existencia amazónicos, refiriéndose en particular a la intensidad de los espíritus selváticos y a la experiencia chamánica con los mundos espirituales. En el contexto de una extensión vegetal dispersa y sobresaliente, afirmamos una sociabilidad cotidiana en el marco de una “ética respetuosa o amorosa” entre todas las formas (...) de vida, expresada estéticamente en formas significantes y transportadoras de emociones desarrolladas por la cosmología amazónica. Para ello utilizamos las nociones que Aby Warburg emplea en su estudio de la cultura de las imágenes, en tanto curso por el que estas pueden entenderse como organismos vivientes susceptibles a transformación, preservando su propia biología en la trasmisión codificada de la memoria.: This exhibition tries to understand the cultural forms of communication and mnemic fixation in a specific narrative that Davi Kopenawa, Yanomami shaman, exposes to the anthropologist Bruce Albert, by virtue of Amazonian modes of existence, especially referring to the intensity of jungle spirits and experience Shamanic with spiritual worlds. In the context of a dispersed and outstanding plant extension, we affirm a daily sociability within the framework of a “respectful or loving ethic” among all life forms, aesthetically expressed in significant and transporting forms of emotions developed by Amazonian cosmology. For this we use the notions that Aby Warburg uses in his study of the culture of images, as a course by which they can be understood as living organisms susceptible to transformation, preserving their own biology in the coded transmission of memory. En los procesos de identificación social muchas veces la valoración del pasado resulta fundamental. La existencia objetiva de esa valoración ha propiciado que distintos actores sociales, en diferentes momentos históricos, hayan hecho uso del pasado en la estructuración de las ideologías que sustentan los procesos de identificación y, en consecuencia, sus propios proyectos políticos. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. En primer término se analiza brevemente el contexto que posibilita en García Lorca la búsqueda de un nuevo lenguaje poético durante su estadía en Nueva York entre 1929-1930. Posteriormente se analiza el concepto de flâneur. Para ello se consideran las elaboraciones que desarrolló Walter Benjamin a propósito de la experiencia de Charles Baudelaire frente a las transformaciones urbanas y sociales que sufrió París a mediados del siglo XIX, durante el Segundo Imperio en Francia. Finalmente se indaga en la eventual configuración (...) de la figura del flâneur en Poeta en Nueva York de Federico Garcia Lorca. First of all, it’s analyzed briefly the context that makes possible in García Lorca the search of a new poetic language during his stay in New York between 1929 and 1930. Subsequently it’s analyzed the concept of flâneur. Because of that, it must be taken into account the devise that Walter Benjamin explained according to Charles Baudelaire’s experience against the urban and social transformations that hit Paris in the 19th century during the Second French Empire. Finally it makes inquiries in the possible configuration of the flâneur in Poeta en Nueva York by Federico García Lorca. (shrink)

En el contexto del sistema presidencial chileno, el artículo analiza el rol del Congreso en la elaboración de la política exterior, desde la perspectiva del enfoque transaccional desarrollado por Pablo Spiller y Mariano Tommasi (2000). De este modo, se plantea que el trabajo del Congreso en general, y de las comisiones de Relaciones Exteriores del Senado y de la Cámara de Diputados en particular, se caracteriza por la permanencia y continuidad de los miembros y, en consecuencia, por un trabajo especializado (...) y de alta calidad profesional, lo que favorece la cooperación entre los actores y los intercambios intertemporales entre éstos. En esta investigación se realiza un análisis sobre el estudio de la sociedad propuesto por Wilhelm Dilthey, con la finalidad de recalcar su postura frente a la comprensión de la humanidad. Presentar cómo ésta a través de la historia va estableciendo relaciones y formando agrupaciones. Un mundo socio-histórico lleno de vivencias que no necesariamente son experimentadas de manera individual, sino que también poseen una exterioridad que se visibiliza en la sociedad. Por esto, el objetivo es analizar cómo el ser histórico (...) se comprende y se relaciona con otros. Cómo puede sentir pertenencia en la cultura, poesía e historia en la que se desenvuelve. La sociedad que está presente hoy en día es cambiante y para nada monótona. Por esto es líquida, según Zygmunt Bauman, pues en ella todo fluye sin detenerse y sin poseer límites. Es una sociedad en la que constantemente se modifican las tendencias según lo más actual. Todo está relacionado a un consumo que posibilita mantener o asimilar un estatus social que permite ser parte del mundo consumista. El parámetro de esta sociedad es consumir para después desechar, y aquí es, (...) donde los individuos deben estar preparados para el cambio. No pueden quedar fuera de las últimas tendencias o son marginados; por tanto, no pueden dejar de consumir. Así es como el trabajo constante y el valor del dinero se han convertido en estas ‘estrategias’ que le permiten a la sociedad prepararse para todos los posibles cambios que puedan surgir. Aspirando a un estatus social que por fin les permita terminar con el miedo que ha instaurado la liquidez consumidora. Debido a todas estas características de la comunidad, el objetivo de este escrito es analizar cómo las agrupaciones que no poseen los recursos necesarios para mantenerse a la par de las tendencias, quedan marginadas y deshumanizadas por no poder consumir y depender del resto; Convirtiéndose en el peor miedo de la sociedad líquida. This article rereads Benedict de Spinoza and recent interpretations of him as an epistemic democrat through the prism of contemporary debate on the conditions for deliberation in a democracy. Through a reconstruction of Spinoza's arguments and theories of deliberation and its preconditions, we argue that, for deliberation to produce the benefits Spinoza recognizes, the process must be inclusive, and those deliberating must be both intellectually humble and autonomous. This interpretation is new and diverges from those recently advanced by Justin Steinberg (...) and Sandra Leonie Field. In particular, on our reading, Spinoza's critique of humility does not extend to intellectual humility as it is understood today in political theory. Both autonomy and humility, as epistemologically conceived by political theorists today, can therefore be considered Spinozian civic virtues. (shrink)

Some scholars have understood that Spinoza’s extreme rationalism, nominalism, conventionalism, and rejection of a semantic theory of truth make his philosophy incapable to use language for philosophical and scientific purposes; insofar he considered language a source of inadequate knowledge, falsity, and error. Thus Spinoza finds contradiction in his inevitable use of language to express his philosophy. This paper has four aims: first, propose an explanation on why language is inadequate knowledge for Spinoza; second, present differences between inadequacy, falsity, and error (...) in language; third, argue on the Spinozian use of the geometrical method as a solution for the adequate use of language in philosophical and scientific work; finally, show the problems and limits of this solution for metaphysical discussions. For Spinoza’s epistemology, an image is an idea that represents an external body as actually existent. This kind of knowledge is the only source of inadequate knowledge, falsity, and error. On the contrary, reason is adequate knowledge because it comprehends common notions, i.e, properties of different things. Intuition is also adequate knowledge because it conceives formal essences of singular things. The main example is the genetic definition of a sphere, an adequate knowledge form by the power of thinking of the (...) mind, without regard to existing extramental spheres. From these differences, some scholars conclude that imagination is always negative and should not deal with reason and intuition. But this conclusion will ban Spinoza’s epistemology from having adequate knowledge of existing individuals, such as Moses and the Hebrew State. In front of this view, this paper defends three theses: firstly, that the difference between the three kinds of knowledge is of genus, not of degree. Secondly, that adequate knowledge for Spinoza is a generic knowledge, i.e., insofar as S knows P insofar S deduces the effects, consequences, or properties of P. Thirdly, that adequate knowledge can include imagination through the proper use of the geometric method. In this case, imagination offers data to reason and intuition for having adequate knowledge of singular things that actually existed. (shrink)

Over the last few years, in part due to the political impact of terrorist activities, the debate on the moral significance of torture as a useful means of obtaining information from enemy combatants has arisen with an urgency not seen in many years. Stressing the importance of exceptional cases, the defenders of torture attempt to justify its acceptance by and back its use in the judicial system of Western democracies. Yet what is at stake here are the basic moral principles—especially (...) that of human dignity-on which our political convictions rest. Admitting of exceptions would change the value of these principles: what once werefixed guidelines for acceptable action now become alterable according to specific political demands, thus making torture into a morally neutral act. The current defence of torture in the West may be a symptom of the progressive absolutization of the State. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. In this article we reflect on the phenomenon of waiting, interpreted in our own context, but drawn from a text by Heidegger. The text implies that the bored person is waiting for the moment in which something will, as they presume, dissipate their boredom. We will proceed to show the internal structure of time as a lived experience of the phenomenon of waiting while bored, and how this time is existentially configured as pain. To do this, the temporal structure of (...) such waiting will be examined phenomenologically to demonstrate how it transforms the existence of whoever is waiting while bored. (shrink)

Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

Resumen: El artículo analiza la musicalización de la ficción presente en Vals de Francesc Trabal, considerada su obra maestra. El artículo sugiere una lectura diferente de la novela a partir del concepto de intermedialidad y mediante dos ejes: la imitación y la tematización. De esta manera se observa que la relación entre esta ficción musicalizada y la noción de ironía metaficcional es muy estrecha y ayuda a entender el juego lúdico establecido por Trabal.: This paper analyzes the musicalization of the (...) fiction present in Vals, the most valued novel of Francesc Trabal. The present article suggests a different reading of this novel based on the concept of intermediality and through two axes: imitation and thematization. Analizan el metabolismo entre la sociedad y la naturaleza, relevando la apropiación de la naturaleza como eje de lo rural mostrando su carácter multidimensional. Jair Bolsonaro, the current President of Brazil, has made himself into one of the most influent advocates of COVID-19 denial. His health policy and his political doctrine are partly based on an implicit moral claim, which is neglected by contemporary political theory. Bolsonarism’s rhetoric raises a moral claim to freedom without responsibility, which relieves its followers from the burdens that emerge from liberal accounts of liberty or from basic goods accepted in a political community. In opposition to liberal or communitarian (...) accounts, Bolsonarism endorses a Hobbesian concept of freedom that describes it as the absence of ‘impediments to motion’. Nonetheless, it differs from Hobbes because it treats this liberty as endowed with moral value and non-negotiable through a social contract. (shrink)

This book provides theoretical tools for evaluating the soundness of arguments in the context of legal argumentation. It deals with a number of general argument types and their particular use in legal argumentation. It provides detailed analyses of argument from authority, argument ad hominem, argument from ignorance, slippery slope argument and other general argument types. Each of these argument types can be used to construct arguments that are sound as well as arguments that are unsound.
